Roblox creator sues Fortnite creator over brainrot meme game

Steal A Brainrot

Spyder Games, the developer behind the viral Roblox hit Steal A Brainrot has filed a lawsuit against the creator of a similar Fortnite-based game, alleging extensive copyright infringement involving “artwork, objects, design, and game elements.”

According to court documents filed in California last week and first reported by Aftermath, Steal A Brainrot creator Spyder Games accuses Stealing Brainrots, a Fortnite Creative title developed by Thomas Van Der Voort, of unlawfully replicating key aspects of its original game. Spyder Games asserts that it secured the official rights to Steal A Brainrot in August before initiating legal action.

The complaint highlights Steal A Brainrot extraordinary success since its May 2025 debut, citing nearly six billion total plays, a concurrent peak of 20 million players, and a consistent ranking among the platform’s top three games by player count. In contrast, Stealing Brainrots was not released on Fortnite’s Creative platform until July 2025, roughly two months later.

However, while Spyder claims it has official licensing for the Brainrot game, the so-called ‘Italian Brainrot’ series of memes including Tralalero Tralala, Bombardiro Crocodilo, Tung Tung Tung Sahur, have mixed origins. The characters are AI created and generated by several users. And the questionable origins of any AI generated character seems to throw the entire claim into disarray.

Beyond this, there are dozens upon dozens of Brainrot games in creator marketplaces across many games. A quick search found multiple instances of Tung Tung Tung Sahur and Brainrot across Minecraft, the Steam Workshop (in multiple games), Roblox, Fortnite, and beyond.

Misguided legal challenges over things you barely own are sadly nothing new in gaming. In July 2024, Garry Newman, creator of  Garry’s Mod (Gmod) and Facepunch Studios founder, revealed that the creators of Skibidi Toilet, a series of viral videos created using Gmod and  Half-Life assets, had sent them a DMCA claim. This, then, seems like another bizarre and misguided legal step. Although not confirmed, it also seems likely that the Roblox Creator’s EULA takes away much of the venom of the Steal A Brainrot creator’s challenge. For instance, Roblox already has the rights to use your creation for their own use.

And, perhaps more practically, if Roblox decides it doesn’t want its name dragged through the new cycle for something called ‘Steal A Brainrot,’ it could just decide to deplatform the game. After all, why worry about smoke when you can just put out the fire.
